You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4.3 Eligibility

You must be at least 18 years old to create an account and use Busk. By registering, you represent and warrant that you meet this age requirement.

4.4 One Account Per User

Each user may maintain only one active account. Creating multiple accounts may result in suspension or termination of all associated accounts.

5.1 Acceptable Use

You agree to use Busk only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform in any way that violates applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm other users
• Interfere with or disrupt the platform's operation
• Attempt to gain unauthorized access to any part of the platform
• Use automated systems or software to extract data from the platform

5.2 Communication

All communication between users must be conducted through Busk's messaging system. We monitor communications to ensure compliance with our policies and to protect users from fraud and abuse.

5.3 User Content

You are responsible for all content you post on Busk, including photos, descriptions, and messages. You grant Busk a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the platform.

6.1 Creating Listings

When listing an item, you must provide accurate and complete information, including:

• Clear, authentic photographs of the actual item
• Accurate description of the item's condition
• Correct size and measurements
• Any defects, damage, or wear
• School affiliation (where applicable)

6.2 Permitted Items

Only school uniform items and related accessories in acceptable condition may be listed on Busk. Items must be clean and suitable for continued use.

6.3 Pricing

Sellers set their own prices. Once an item is purchased, the price cannot be changed. You agree that your listed price is fair and reflects the item's condition.

6.4 Listing Approval

Busk reserves the right to review, approve, reject, or remove any listing at our discretion. Listings that violate our policies will be removed without notice.

7.1 Making Purchases

When you purchase an item, you enter into a binding agreement to buy that item at the listed price plus any applicable fees and shipping costs.

7.2 Payment

Payment must be made through Busk's secure payment system. We accept various payment methods as indicated on the platform. Your payment information is processed securely through our payment partners.

7.3 Order Confirmation

After completing a purchase, you will receive an order confirmation. This confirmation does not constitute acceptance of your order by the seller until the seller ships the item.

7.4 Receiving Items

Once you receive an item, you should inspect it promptly. If the item does not match the description or has issues, you must notify us within the timeframe specified in our Buyer Protection policy.

8.1 Seller Obligations

As a seller, you agree to:

• Provide accurate item descriptions and photographs
• Honor all sales at the listed price
• Ship items promptly and securely
• Respond to buyer inquiries in a timely manner
• Provide tracking information when available
• Package items appropriately to prevent damage

8.2 Shipping Timeframe

Sellers must ship items within 3 business days of receiving payment, unless otherwise agreed with the buyer or specified in the delivery method chosen.

8.3 Seller Performance

Busk may monitor seller performance, including shipping times, item accuracy, and customer satisfaction. Poor performance may result in account restrictions or termination.

8.4 Prohibited Sales Practices

Sellers must not engage in price manipulation, false advertising, bait-and-switch tactics, or any other deceptive sales practices.

9.1 Payment Processing

All payments are processed through our secure payment partner, Stripe. By making a purchase or sale, you agree to comply with Stripe's terms and conditions.

9.2 Buyer Protection Fee

Buyers pay a Buyer Protection fee of £0.70 plus 5% of the order subtotal. This fee provides coverage for lost, damaged, or misrepresented items.

9.3 Seller Payments

Sellers receive payment once the transaction is completed. Busk may hold payments temporarily to ensure buyer satisfaction and prevent fraud.

9.4 Refunds

Refunds are issued in accordance with our Buyer Protection policy. Processing times vary depending on your payment method and financial institution.

9.5 Currency

All transactions are conducted in British Pounds (GBP).

10.1 Delivery Methods

Busk supports multiple delivery methods:

• Post/courier delivery
• Collection in person (arranged between buyer and seller)
• Collection from school (where the school has opted into the program)

10.2 Shipping Costs

Shipping costs are displayed during checkout and are the responsibility of the buyer unless otherwise stated in the listing.

10.3 Delivery Times

Estimated delivery times are provided for guidance only. Actual delivery times may vary due to factors beyond our control, including courier delays and adverse weather conditions.

10.4 Lost or Damaged Items

If an item is lost or damaged during shipping, the matter should be reported immediately through our Buyer Protection system. We will work to resolve the issue in accordance with our policies.

Our Buyer Protection program covers:

• Items that arrive damaged or faulty
• Items that do not match the listing description
• Items that never arrive
• Fraudulent transactions

To be eligible for Buyer Protection, you must:

• Report issues within 48 hours of receiving the item
• Provide evidence of the issue (photos, descriptions, etc.)
• Cooperate with our investigation process
• Make all purchases through Busk's payment system

The following activities are strictly prohibited on Busk:

• Selling counterfeit, stolen, or unauthorized items
• Selling items that are not school uniforms or related accessories
• Listing items in unacceptable condition (e.g., heavily damaged, stained, or unhygienic)
• Manipulating reviews or ratings
• Circumventing Busk's payment system
• Sharing contact information to complete transactions outside the platform
• Using the platform for money laundering or other illegal activities
• Harassing, threatening, or abusing other users
• Creating multiple accounts to manipulate the system
• Using automated tools to scrape data or create listings

Violations of these prohibitions may result in immediate account suspension or termination, and Busk may report illegal activities to law enforcement authorities.

13.1 Busk's Intellectual Property

All content on the Busk platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Busk or its licensors and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

13.2 User Content Rights

You retain ownership of the content you post on Busk. However, by posting content, you grant Busk a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display your content in connection with operating and promoting the platform.

13.3 Trademark Rights

School logos and trademarks remain the property of their respective owners. Users may display these marks only as necessary to accurately represent the school affiliation of uniform items being sold.

13.4 Copyright Infringement

If you believe that your copyright has been infringed on Busk, please contact us immediately with details of the alleged infringement. We take copyright violations seriously and will investigate all claims.

15.1 Platform Role

Busk acts as a marketplace platform connecting buyers and sellers. We are not a party to the actual sale agreements between users. Busk is not responsible for:

• The quality, safety, legality, or accuracy of items listed
• The truth or accuracy of users' content or listings
• The ability of sellers to complete sales or buyers to complete purchases
• The actions or conduct of users on or off the platform

15.2 No Warranty

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Busk does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.

15.3 Limitation of Damages

To the maximum extent permitted by law, Busk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

15.4 Maximum Liability

In any event, Busk's total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you to Busk in the twelve (12) months prior to the action giving rise to liability.

16.1 User Disputes

Disputes between buyers and sellers should first be resolved through direct communication. Busk provides a messaging system to facilitate this communication.

16.2 Busk Assistance

If direct communication does not resolve the issue, users may request assistance through our dispute resolution process. We will review the situation and make a determination based on available evidence and our policies.

16.3 Dispute Resolution Terms

By using Busk, you agree to first attempt to resolve any disputes informally before pursuing formal legal action. If informal resolution is not successful, you agree to arbitration as described in our full dispute resolution terms.

16.4 No Class Actions

You agree that disputes will be resolved on an individual basis and waive any right to bring or participate in class action lawsuits or class-wide arbitrations.

17.1 Termination by User

You may close your account at any time by contacting our support team. Upon closure, you must complete any pending transactions before your account is fully terminated.

17.2 Termination by Busk

Busk reserves the right to suspend or terminate your account at any time for:

• Fraudulent or illegal activity
• Breach of our community guidelines
• Multiple complaints from other users
• Extended periods of inactivity
• Any other reason at our sole discretion

17.3 Effect of Termination

Upon termination, your right to use the platform immediately ceases. You remain responsible for any outstanding obligations, including pending transactions and fees.

Sections of these Terms that by their nature should survive termination will remain in effect, including provisions regarding intellectual property, limitation of liability, and dispute resolution.
